US Court Orders EscapeX, Lawyers To Pay Google USD 2.5 Lakh As Cost For Frivolous Patent Suit

The United States Court of Appeals for the Federal Circuit has upheld a California court’s order directing mobile app developer EscapeX to pay Google more than USD 2.5 lakh in attorneys’ fees and litigation costs, after finding that the company pursued a frivolous patent infringement lawsuit and attempted to unnecessarily prolong the proceedings.

The appellate court agreed with the lower court’s finding that EscapeX’s claims lacked merit from the outset and that its conduct during and after the litigation justified the imposition of monetary sanctions.

Background of the Dispute

EscapeX had filed a patent infringement suit against Google, alleging misuse of its technology. However, the trial court found that the claims were baseless and unsupported by credible evidence. The court further observed that instead of accepting the outcome, EscapeX sought to extend the litigation by filing an equally meritless post-judgment motion.

As a result, the California court ordered EscapeX to compensate Google for the legal expenses incurred in defending the case.

Upholding the order, the Federal Circuit noted that:

  1. The lawsuit was objectively frivolous

  2. EscapeX failed to present any viable legal or factual basis for its infringement claims

  3. The post-judgment motion was filed only to delay finality and increase litigation costs

The court found no error in the lower court’s decision to award attorneys’ fees and costs to Google under applicable legal standards governing exceptional cases.

Amount Awarded

The total amount awarded exceeded USD 2.5 lakh, which included USD 63,525 specifically attributed to costs incurred by Google in responding to EscapeX’s post-judgment motion.

Legal Significance

The ruling reinforces the principle that courts will not tolerate abuse of the judicial process through frivolous patent litigation. It also serves as a cautionary precedent for entities attempting to use patent lawsuits as a strategy to harass or pressure larger corporations without substantive legal grounds.
